PokeTALK offers various telecommunication services for your business and private usage. The terms and conditions are for your benefit. PokeTALK is a service offered by E Mobile Incorporated Canada which believes in transparency in all operations. By registering with PokeTALK you agree to these terms.
Users Obligations: As a registered user at PokeTALK you agree to abide by the terms & conditions presented herein. PokeTALK, or any of its employees, agents, or cooperating service providers will not be liable for any non-delivery or any other errors or omissions in the provisions of such services.
Emergency calling: Although PokeTALK is an advanced form of telecommunications; it is not a substitute for emergency calls. If you wish to call any type of hospital, law enforcement agency, medical care unit or any other kind of emergency service PokeTALK may not transfer your local presence details which may be required. By agreeing to these terms you agree that PokeTALK and its employees may not be held liable for any claim, damage, or loss, and you hereby waive any and all such claims or causes of action, arising from or relating to the use of PokeTALK to contact emergency services personnel.
PokeTALK's Rights: PokeTALK tries its hardest to provide the highest quality service. PokeTALK reserves the right to refuse accounts or limit the service, as well as suspend or terminate accounts without further notice. If PokeTALK suspects that you have abused the service, or that you are using your account for illegal reasons, your account will be shut down. PokeTALK also reserves the right to not always offer the service, and cannot guarantee that your communications will be without disruptions, delays, or errors. Since the PokeTALK service is transmitted on public telephony infrastructures the quality is not always dependent on us.
Intellectual Property Rights: You acknowledge that all of PokeTALK's services are confidential and valuable assets of PokeTALK. PokeTALK services and content including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like and the trademarks, service marks and logos, are owned by or licensed to PokeTALK, and subject to copyright and other intellectual property rights under United States, foreign laws and international conventions.
Privacy: PokeTALK greatly respects your privacy and is committed to protect the personal information that you share, as described in the Privacy Policy.
Service: PokeTALK will attempt to provide services as described in its marketing materials and website, but does not warrant such services to be error free. You may not use PokeTALK for any unlawful purpose, and you are responsible for the consequences of unlawful use or any slander, libel or other actionable content in any message. PokeTALK reserves the right to refuse to provide its services, or deactivate your account without further notice. You agree to not hold PokeTALK, or any of its employees, directors, agents or cooperating service provider(s) responsible for any misunderstanding of the service, or its terms, or any misdelivery, non-delivery, or any other errors or omissions in the provision of such services.
Refund: Refunds may be requested by simply emailing team@poketalk.com with your account details and the requested refund amount. The refunds will be available for all unused monetary transfers made to PokeTALK not inclusive of bonuses earned or promotions. PokeTALK also reserves the right to reject the refund requests if any abuse or suspicious account activity is believed to have occurred.
Indemnity: By using PokeTALK you agree to defend, indemnify and hold harmless PokeTALK, its directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Use of and access to the Website (www.poketalk.com or www.poketalk.biz ), (ii) Violation of any term of these Viewer Terms of Use; or (iii) Violation of any third party right, including without limitation any copyright, property, or privacy right.
